The Economic Commission approved an opinion on revisions to the Public Procurement Law this Tuesday, allowing the Department of Local Government Works (DOM) to participate as a bidder in public purchases through companies with an undetermined amount of activity.
Section 25, third paragraph, which refers to administrative ‘bids’ and contract barriers, is amended so that the restrictions do not apply to companies in which DOM is a shareholder.
They create substantial quality and legal certainty to harmonize both the DOM Easy Purchase Act. ” UNAC Director Mauro Jovel
The project incorporates the Civil Protection, Disaster Prevention and Mitigation Fund (Fopromid) and the El Salvador Fund for Pre-Investment Research (Fosep) as subject to legislation.
“When DOM is established as a shareholding institution, it is to give dynamism to this kind of process that requires a lot of initiative or lacks participation from bidders,” said Director of Procurement and Contracts. Mauro Jovel, who is the Regulatory Department of the Ministry of Finance (UNAC).
It is not true that the aim is to harmonize the process, streamline it or improve the population of the territory. The DOM already shows that it’s not possible. ” Anabel Belloso, FMLN Deputy Director
“It favors the sector.”
Anabel Belloso of the Farabundo Martí National Liberation Front (FMLN) criticized the lack of clarity on whether the DOM should own majority stakes in these companies. “We’re facing a dynamic of buying from certain sectors of the country’s economy, preferring to contract rather than to solve people’s problems,” he said.
